Caratoke, LLC warrants its
Weather-All Bags (the “Products”) to be free of defects
in materials and workmanship, under normal and intended
use and service thereof, for a period of one year from
the date of purchase from Caratoke or an authorized retailer. In the event of a valid claim
hereunder, Caratoke will, at its option, repair the Product
or replace it with an identical or similar Product. This
warranty shall become null and void upon misuse, alteration,
overload or repair to the Product. This warranty
is not assignable and is limited to the original purchaser
of the Product from Caratoke or an authorized retailer. CARATOKE
EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS, INCLUDING
IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS
FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND THOSE
ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE
OF DEALING OR USAGE OF TRADE. SOME STATES DO NOT
ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING
DISCLAIMER MAY NOT APPLY TO YOU, AND THIS WARRANTY GIVES
YOU SPECIFIC RIGHTS WHICH VARY FROM STATE TO STATE. The remedy set forth herein is the sole and exclusive remedy available from Caratoke. CARATOKE
SHALL NOT BE LIABLE, IN ANY EVENT, FOR ANY INJURY, LOSS,
CLAIM, DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT,
INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING,
BUT NOT LIMITED TO LOST PROFITS), WHETHER BASED IN CONTRACT,
TORT, STRICT LIABILITY, OR OTHERWISE, THAT ARISES OUT OF
OR IS IN ANY WAY CONNECTED WITH THE PERFORMANCE OR NON-PERFORMANCE
OF ANY CARATOKE PRODUCT EVEN CARATOKE HAS BEEN ADVISED
OF THE POSSIBILITY OF DAMAGES THERETO OR ANY OTHER PARTY.
WARRANTY PROCEDURES
Please inspect your shipment
upon receipt, and, if your Product has been damaged in
shipment, you must contact us within twenty-four (24)
hours of receipt in order to register a claim. Caratoke will, within thirty (30)
days of shipment of your order, accept a non-special orders
Product for return and refund if the Product is (a) unused,
(b) shipped to us prepaid in its original packaging, (c)
received by Caratoke in undamaged condition and complete
with all parts, hardware, and instructions, and (d) accompanied
by a return authorization number issued by Caratoke. Please
note that Caratoke will not refund shipping costs except
in the event of a return necessitated by our shipping error.
